VA Moves to Expand Same-Sex Benefits After Court Ruling

The Department of Veterans» Affairs is moving to expand access to benefits for same-sex couples who may not have been eligible prior to last week's Supreme Court ruling.

Prior to the court's decision in Obergefell v Hodges, «veterans» benefits for same-sex couples had been withheld in states where marriages between people of the same gender are not legally recognized. The ruling, which was handed down on Friday, struck down those state laws and cleared the path for VA's decision to recognize all same-sex marriages, which it announced Monday.

"VA may recognize the same-sex marriage of all «Veterans», where the «Veteran» or the «Veteran»'s spouse resided anywhere in the United States or its territories at the time of the marriage or at the time of application for benefits," the department said in a statement on the ruling.

Following Friday's decision, advocates wasted little time calling for the VA to change gears and begin providing benefits it has previously denied. And Monday, groups were quick to applaud the shift.

"This is a critical step that will help to make sure that every lesbian, gay and bisexual U.S. «veteran» and their family has the same access to the benefits that they have earned in their service to our country," Matt Thorn, interim executive director of Outserve-Servicemembers Legal Defense Network, said in a statement.

"Our LGB «veterans» should never have been denied these benefits because of the state they live in or because of their sexual orientation," Thorn added. "LGB «veterans and their families deserve and will now have the respect, dignity and protections that they have earned."

In its statement, VA said it will issue guidance to its offices and employees on implementing the decision and, in the meantime, would "temporarily wait to adjudicate all claims regarding same-sex marriage that cannot be immediately granted based on prior guidance."

Court of Appeals Grants State of Michigan's Request for Immediate Effect of Rules
On Thursday, June 25, 2015, the Court of Appeals granted the State of Michigan and the Michigan Gaming Control Board's request for the rules to be given immediate effect.

This means that, pursuant to the Court of Appeals recent 2-1 decision, the rules promulgated in May 2014 (to which MiCGA and other plaintiffs were successful in the Court of Claims at receiving injunctive relief from) have taken immediate effect.

The former rules that organizations had been operating under (with the exception of some of the compromised emergency rules from Fall 2014) can be viewed here.

As a benefit to our MiCGA members, we have prepared a document that highlights the most significant changes that charities and suppliers will need to be aware of.

No word yet from the Michigan Gaming Control Board on how they may be assisting organizations in their implementation and compliance with the new rules.

 WASHINGTON (June16, 2015) -  "Unbelievable," was how American Legion National Commander Michael D. Helm described a report that  more than $54.4 million of prosthetics were purchased by VA employees in the Bronx using government credit cards.
 
"Nothing here passes the smell test," Helm said. "Each time the government cards were used for this purpose, it was for $24,999.  This is just under the limit for the contracting guidelines. It's either a remarkable coincidence or an orchestrated effort to get around contracting requirements. The president promised to preside over 'the most transparent administration in history.' Apparently VA didn't get the memo."
 
Helm pointed out that for the total to be so high, the Bronx VA must be providing an extraordinarily high amount of prosthetics. "By my math it comes out to 2,177 transactions.  Moreover, we hear that VA officials wanted to tell Congress that documents were destroyed by Hurricane Sandy when the dates don't even match up. What next, the dog ate my homework? The American Legion has long supported the Department of Veterans Affairs because we believe the government has a solemn obligation to care for our veterans. But every day – with each scandal – it becomes more and more difficult. This is not just a slap in the face to our heroes who need prosthetics, but a complete disregard for the taxpayers who fund such purchases. We call on Congress and the administration to insist that VA document how this money was spent or refer this case to the Justice Department for possible prosecution."

 VA Expands Disability Benefits for Air Force Personnel Exposed to Contaminated C-123 Aircraft

WASHINGTON – The Department of Veterans Affairs (VA) today published a new regulation that expands eligibility for some benefits for a select group of Air Force Veterans and Air Force Reserve personnel who were exposed to the herbicide Agent Orange through regular and repeated contact with contaminated C-123 aircraft that had been used in Vietnam as part of Operation Ranch Hand (ORH).

VA published this regulation as an interim final rule so that it could immediately begin providing benefits to eligible Air Force veterans and Air Force Reserve personnel who submit a disability compensation claim for any of the 14 medical conditions that have been determined by VA to be related to exposure to Agent Orange.

Secretary of Veterans Affairs Robert A. McDonald made the decision to expand benefits following receipt of a 2015 report by the National Academy of Sciences Institute of Medicine (IOM) on Post-Vietnam Dioxin Exposure in Agent Orange-Contaminated C-123 Aircraft. This VA-requested report found evidence that as many as 1,500 to 2,100 Air Force and Air Force Reserve personnel who served as flight, medical and ground maintenance crew members on ORH C-123 aircraft previously used to spray Agent Orange in Vietnam were exposed to the herbicide.

"Opening up eligibility for this deserving group of Air Force veterans and reservists is the right thing to do," said Secretary McDonald. "We thank the IOM for its thorough review that provided the supporting evidence needed to ensure we can now fully compensate any former crew member who develops an Agent Orange-related disability."

Under this new rule, Air Force and Air Force Reserve flight, medical and ground maintenance crewmembers who served on the contaminated ORH C-123s are presumed to have been exposed to herbicides during their service, thus making it easier for them to establish entitlement for some VA benefits if they develop an Agent Orange-related presumptive condition. In addition, for affected Air Force Reserve crew members, VA will presume that their Agent Orange-related condition had its onset during their Reserve training. This change ensures that these reservists are eligible for VA disability compensation and medical care for any Agent Orange-related presumptive condition, and that their surviving dependents are eligible for dependency and indemnity compensation and burial benefits.

The interim final rule can be found on the Federal Register: www.federalregister.gov/public-inspection. VA will immediately begin processing claims and issuing benefits to eligible Air Force crew members.

VA encourages reservists who were assigned to flight, ground or medical crew duties at Lockbourne/Rickenbacker Air Force Base in Ohio (906th  and 907th Tactical Air Groups or 355th and 356th Tactical Airlift Squadron), Westover Air Force Base in Massachusetts (731st Tactical Air Squadron and 74th Aeromedical Evacuation Squadron) or Pittsburgh, Pennsylvania, International Airport ( 758th Airlift Squadron) during the period 1969 to 1986, and developed an Agent Orange-related disability to file a disability compensation claim online through the joint VA-Department of Defense web portal, eBenefits (https://www.ebenefits.va.gov/).

VA also has identified several active duty locations where ORH C-123 aircraft may have been used following their service in Vietnam. Active duty personnel who served in a regular USAF unit location where a contaminated C-123 was assigned and who had regular and repeated contact with the aircraft through flight, ground or medical duties during the period 1969 to 1986, and who develop an Agent Orange-related disability, also are encouraged to apply for benefits. For more information on applying for these benefits, including the affected units, Air Force Specialty Codes and dates of service for affected crew members, and a listing of Agent Orange-related conditions, visit www.benefits.va.gov/COMPENSATION/claims-postservice-agent_orange.asp

In order to avoid unnecessary delay of benefits, claimants should annotate "(C-123)" after each Agent Orange related disability in Part II, Block 14 of VA Form 21-526 or Section I, Block 11 of VA

Form VA Form 21-526EZ when filing on eBenefits.  Example: Diabetes (C-123).  If claimants have any of the following documents, they should be attached to their application:

  • Discharge, separation papers,  (DD214 or equivalent)
  • USAF Form 2096 (unit where assigned at the time of the training action)
  • USAF Form 5 (aircraft flight duties)
  • USAF Form 781 (aircraft maintenance duties)
  • Dependency records (marriage & children's birth certificates)
  • Medical evidence (doctor & hospital reports)

VA will process all claims related to C-123 exposure at the St. Paul, Minnesota, VA Regional Office.  Claims not filed through eBenefits should be mailed to the following address (or faxed to 608-373-6694):

"Founding of the Vietnam Veterans of America (VVA)" A film documentary about the founding of the VVA is being finished up and will soon be released on a DVD. "Friday, June 5, 2015" The Tunnel to Towers Foundation, along with General Motors, is hosting a gala at the Detroit Marriott Renaissance Center, on Jefferson, starting at 6PM. "Friday, June 5, 2015" The Dove Fund, which builds schools, hospitals, etc., in Vietnam, mostly with Vietnam Veterans, is hosting its 15th annual golf outing at the South Toledo Golf Club, 3915 Heatherdowns Blvd, Toledo, with a 11:30AM shotgun start. "Saturday, June 13, 2015" The South Vietnam Disabled Veterans residing in Vietnam are having a fund-raiser hosted by the Vietnamese American Association of Michigan, S Vietnam Veterans & Former Civil Servants, at the Bellagio Banquet Hall, 4100 E 14 Mile, Warren, from 7PM to 1AM. Special entertainment includes musical performances and dances. Admission is $25. This event is being supported by VVA Chapter 9. For more information see flyer.
